1. Agreement to Terms
By accessing or using the website and services provided by AdvanceUp ("we", "us", or "our"), you agree to these Terms of Service. If you do not agree, you may not access or use our services.
2. Services Offered
AdvanceUp provides digital marketing services including website design, development, hosting, and local SEO management. Specific deliverables are outlined in your service agreement or invoice. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.
3. Payments & Billing
Recurring Billing: Service plans are billed on a recurring monthly basis. By signing up, you authorize us to charge your payment method automatically each month.
Late Payments: Failure to pay may result in the suspension of your website or services. Re-activation fees may apply.
Cancellations: You may cancel your monthly service at any time by contacting us. Cancellations must be received at least 5 business days before your next billing cycle to avoid being charged for the subsequent month.
4. Intellectual Property
Client Content: You retain ownership of all text, images, and content you provide to us for your website.
Our Work: Upon full payment of the initial setup or design fee, ownership of the completed website design and deliverables transfers to you. However, any proprietary tools, software, or code libraries used by AdvanceUp to build or host the site remain our property.
5. User Conduct
You agree not to use our services for any unlawful purpose, or to transmit any material that is harassing, defamatory, invasive of another's privacy, or otherwise objectionable. We reserve the right to terminate service for any client violating these standards.
6. Limitation of Liability
To the fullest extent permitted by law, AdvanceUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of our services. Our total liability for any claim arising out of these terms shall not exceed the amount you paid us in the past 6 months.
7. Third-Party Services
Our services may integrate with third-party platforms (e.g., Google, Facebook, Stripe). We are not responsible for the availability, accuracy, or policies of these external services. Your use of such services is subject to their respective terms and policies.
8. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
